« Après plusieurs reports, notamment du fait du président d’alors, Laurent Gbagbo, une élection présidentielle a été tenue en Côte d’ Ivoire l’ automne dernier . Depuis, ses résultats ont été certifiés par la Commission Electorale Indépendante et reconnus par la communauté internationale, y compris les États-Unis, l'Union Européenne (l'UE), la Communauté Économique d'États Africains Ouest (ECOWAS) et l'Union africaine (AU).”
Le Sénateur répond :
En fait la Commission Electorale Indépendante ne s’est pas conformée à l’obligation qu’ elle avait en vertu de la loi d’ annoncer les résultats provisoires du vote dans un délai de trois jours. Elle les a annoncés près de 16 heures après le délai qui lui était imparti par la loi pour les transmettre au Conseil Constitutionnel. A mon avis, c'est au Conseil Constitutionnel de Côte d’ Ivoire et non à la Commission Electorale qu’ il appartient de proclamer les résultats définitifs et de déclarer le vainqueur des élections présidentielles. Il semble que cette élection ne s’est pas déroulée conformément à la constitution de la Côte d’ Ivoire. Par ailleurs, il y a des preuves de fraude électorale massive dans les zones tenues par les rebelles au nord. J'ai soumis ces preuves dans deux lettres à la Secrétaire d’ Etat Clinton et attends une réponse à ces questions spécifiques
Les preuves transmises au Secrétaire d’ Etat Clinton incluent des résultats de circonscriptions où, au premier tour de scrutin, le Président Laurent Gbagbo avait obtenu plusieurs milliers de voix, mais curieusement au second tour il aurait recueilli zéro voix. J'ai aussi inclus parmi ces preuves un document électoral avec des résultats régionaux officiels, où Ouattara a obtenu 149,598 voix au total dans une des cinq régions du Nord. Mais quand le total a été officiellement reporté dans la colonne "vote total”, Ouattara reçoit 244,471 voix; soit une différence de 94,873 voix. Avec toutes les preuves que j’ ai pu rassembler je suis maintenant convaincu que c'est mathématiquement impossible pour le Président Gbagbo d'avoir perdu l'élection par plusieurs centaines de milliers de voix. Et si une quantité semblable de fraude existe dans les quatre autres régions du nord tenues par les rebelles, Gbagbo est vraiment le vainqueur de l'élection présidentielle.
L’ Ambassadeur dit:
« Depuis la proclamation des résultats, l’ ancien Président Laurent Gbagbo a refusé non seulement de les reconnaître, et d’ écouter la volonté du peuple de Côte d’ Ivoire, mais a rejeté en fait plusieurs initiatives, y compris celles de l'UA, de l’ECOWAS et d’ autres dirigeants africains, en vue d’ éviter toute effusion de sang et de trouver une solution pacifique de la crise. Tout dernièrement encore, il a refusé d'accepter des propositions du Groupe de Haut Niveau de l’ UA tandis que ces propositions ont été formellement acceptées par le Président Ouattara ».
Le Sénateur répond:
Faux . Pas plus tard que le 27 mars, 2011 l'Union africaine a envoyé l’ancien ministre des Affaires étrangères du Cap Vert, Jose Brito pour agir en médiateur entre Ouattara et Gbagbo. Gbagbo a accepté la médiation, mais Ouattara l'a refusé.
L’ Ambassadeur dit:
Ce blocage a précipité une détérioration de la situation humanitaire. Par ailleurs, il a mené à la violence croissante, dont les premières victimes ont été des civils, malgré la présence sur place de l'opération des Nations Unies en Côte d’ Ivoire (ONUCI). C'est dans ce contexte que le Conseil de Sécurité de l’ ONU a adopté sa Résolution 1975 le 30 mars. Cette décision a été adoptée à l'unanimité, y compris avec un vote positif des Etats-Unis et des trois membres africains du Conseil (à savoir, Gabon, Nigéria et Afrique du Sud). Elle renforce la protection des civils, et interdit l'usage d'armes lourdes , comme un élément clé de l'exécution impartiale du mandat de l’ ONUCI.
Le Sénateur répond:
Il n'y a pas de preuve que le Président Gbagbo a ordonné des tirs d'obus ou le massacre de civils dans Abidjan ou à travers le pays. Il l'a nié à maintes reprises, et ce sont en fait les forces sous le contrôle de Ouattara qui ont mené des actions militaires et terroristes.
Ceci a consisté en des assauts sur les Forces Armée et de Police par« le commando invisible » et l’ offensive illégale lancée depuis le nord qui a mené à la présente crise.
L’ Ambassadeur dit:
En Côte d’ Ivoire, les forces françaises agissent sur la base d'un mandat international du Conseil de sécurité, en soutien à l'opération de maintien de la paix de l’ ONU (ONUCI).
Le Sénateur répond:
L’ accent devrait être mis sur l’ expression « maintien de la paix ». Malheureusement, les forces françaises et des Nations Unies ne s’ impliquent pas assez dans le maintien de la paix, mais plutôt cherchent a provoquer la guerre
L’ Ambassadeur dit:
« Tout récemment, leur intervention a été strictement conforme à la Résolution 1975, et répondait à une demande au Président Sarkozy par le Secrétaire d'ONU, Ban, en vue de soutenir l’ ONUCI dans l’ exécution de son mandat. En particulier, l’ action des forces françaises d’ intervention dans Abidjan a été strictement conforme à cet objectif, et a été conçue pour neutraliser les armes lourdes utilisées contre les populations civiles et le personnel d'ONU dans Abidjan ».
Le Sénateur répond:
Faux. Abidjan est une ville densément peuplée de quatre millions de personnes. Dans cet environnement urbain, les dommages collatéraux causés par les interventions des « Soldats de la paix » de l'ONU et les hélicoptères d'assaut français et les troupes terrestres ont causé des centaines sinon des milliers de blessés civils. En particulier, les centaines de jeunes en soutien du Président Gbagbo massés en bouclier humain autour du palais présidentiel pour tenter d’ arrêter l’ offensive de Ouattara et des Français . Personne ne sait combien de ces jeunes ont été tués par les forces françaises et de l’ ONU.
L’ Ambassadeur dit:
« Dans le cadre de son engagement à la protection de civils et le combat contre l'impunité en Côte d’ Ivoire, comme dans le reste de l'Afrique et du monde, la France a réitéré son appel pour un arrêt immédiat de toutes les violences contre les civils, et a souligné que les auteurs de ces crimes doivent en répondre devant une cour de justice. La France accueille avec satisfaction la promesse du Président Ouattara à cet égard ».
Le Sénateur répond:
Le seul massacre rapporté de civils a été commis par les forces de Ouattara actuellement alliées à l'ONU et aux Français. Ceci est arrivé dans la ville de l'Ouest , Duekoue où jusqu'à 1000 personnes ont été massacrées par les Dozos, les chasseurs traditionnels qui ont combattu à côté des forces de Ouattara. Ceci a été confirmé par les Nations unies et Human Rights Watch
L’ Ambassadeur dit:
« La France attend avec impatience la fin de la violence actuelle, et espère que l'ordre constitutionnel et démocratique prévaudra finalement. C'est au président Ouattara et au peuple de Côte d’ Ivoire de trouver les solutions politiques qui favoriseront l’ avènement d’ une nation démocratique, paisible, prospère et réconciliée ».
Le Sénateur répond:
Faux. Le président Gbagbo a lancé plusieurs fois un appel à un cessez-le-feu immédiat qui a été ignoré par Ouattara, les forces de l'ONU et les Français. Il peut être mis fin immédiatement aux tueries si ces forces acceptent un cessez-le-feu.
Conclusion ( du Sénateur)
Mercredi dernier, le 6 avril, a marqué le 17ème anniversaire du génocide rwandais de 1994. Nous savons maintenant que l'ONU, son Secrétaire Général de l époque,Koffi Annan et d'autres étaient conscients de l'étendue de cette violence, mais n’ ont rien fait pendant qu’il était temps pour y remédier. Nous voulons tous empêcher un autre génocide d'arriver. C’ est pourquoi les Etats-Unis doivent appeler à un cessez-le-feu immédiat pour empêcher Ouattara et son armée de rebelles de commettre encore plus de massacres d’ Ivoiriens.
Enfin, je renouvelle ma demande au Président Kerry du Comité des Relations Extérieures du Sénat en vue de convoquer une audience le plus tôt possible pour examiner les atrocités commises par les forces loyales à Ouattara, le chef des rebelles, de même que ce qui, de mon point de vue, a été une élection mal conduite, qui lui a conféré la légitimité de revendiquer la présidence.

French say:
Fact Sheet on Côte d’Ivoire(April 6, 2011)“After many delays, including on the part of then-President Laurent Gbagbo, a presidential election was held in Côte d’Ivoire last fall. Since then, its results have been certified by the local monitoring mission and acknowledged by the international community, including the United States, the European Union (EU), the Economic Community of West Africa States (ECOWAS), and the African Union (AU).”
Inhofe responds:
In fact the Independent Electoral Commission did not fulfill its constitutional mandate to announce the final provisional vote tallies within three days. It announced them almost 16 hours after it was constitutionally mandated to report them to the Constitutional Council. And it is my understanding, that it is the Constitutional Council of Cote d’Ivoire and not the Electoral Commission which certifies and declares the winner of presidential elections. It seems that this election was not carried out in accordance with the constitution of Cote d’Ivoire. In addition, there is evidence of massive electoral fraud in the rebel held north. I submitted this evidence in two letters to Secretary Clinton and am awaiting a response to these specific allegations. The evidence submitted to Secretary Clinton includes tallies of precincts where, in the first round of voting, President Laurent Gbagbo received multiple thousands of votes, but in the second round he received zero votes. I also submitted an electoral document showing official regional electoral returns, where it shows Ouattara receiving a total 149,598 from one of five northern regions. But when the total is officially reported in the “total vote” column, Ouattara receives 244,471; a difference of 94,873 votes. From all the evidence I now have gathered, I am convinced that it is mathematically impossible for President Gbagbo to have lost the election by several hundred thousand votes. And if a similar amount of fraud exists in the other four regions of the rebel-held north, Gbagbo is actually the winner of the presidential election.
French say:
“Since the results, former President Laurent Gbagbo has not only refused to acknowledge the results, and listen to the will of the people of Côte d’Ivoire, but actually dismissed several initiatives, including by the AU, ECOWAS and other African leaders, to avert any bloodshed and find a peaceful solution of the crisis. Most recently, he again refused to accept proposals by the AU High Level Group, while these proposals have been formally accepted by President Ouattara.”
Inhofe responds:
Not true. As late as March 27, 2011 the African Union sent former Cape Verde foreign minister Jose Brito to mediate between Ouattara and Gbagbo. Gbagbo accepted the mediation, but Ouattara rejected it.
French say:
“This deadlock has precipitated a deterioration of the humanitarian situation. In addition, it has led to growing violence, of which the first victims have been civilians, in spite of the presence on the ground of the U.N. Operation in Côte d’Ivoire (UNOCI). It is in this context that the United Nations Security Council adopted its Resolution 1975 on March 30. This decision was adopted unanimously, including with a positive vote from the United States and the three African members of the Council (namely, Gabon, Nigeria and South Africa). It stresses the protection of civilians, and the need to prevent the use of heavy weapons in this regard, as a key element of the impartial implementation of UNOCI’s mandate.
Inhofe responds:
There is no evidence that President Gbagbo ordered the shelling or killing of civilians in Abidjan or throughout the country. He has repeatedly denied it, and it is in fact actions by forces under the control of Ouattara who have carried out military and terrorist actions. This consisted of attacks upon police and Army forces by his “invisible commandos” and the outright offensive launched from the north that has led to the present crisis.
French say:
“In Côte d’Ivoire, French forces are acting on the basis of an international mandate given by U.N. Security Council, in support to the internationally constituted U.N. peacekeeping operation (UNOCI).”
Inhofe responds:
Focus should be on the word “peacekeeping”. Unfortunately, the United Nations and French forces are not engaging in peacekeeping, but war making.
French say:
“Most recently, their intervention has been strictly consistent with Resolution 1975, and responded to a request to President Sarkozy by UN Secretary-General Ban with a view to support UNOCI as it enforces its mandate. In particular, French forces’ intervention in Abidjan has been strictly consistent with this goal, and designed to neutralize the heavy weapons used against civilian populations and UN personnel in Abidjan.”
Inhofe responds:
Not true. Abidjan is a densely populated city of four million people. In this urban environment, the collateral damage caused by the attacks by UN “Peacekeeper” and French attack helicopters and ground troops has caused hundreds if not thousands of civilian casualties. Specifically, hundreds of youths supportive of President Gbagbo formed a human shield around the presidential palace in an attempt to halt the Ouaratta and French offensive. No one knows how many of these youths have been killed by UN and French forces.
French say:
“In the context of its commitment to the protection of civilians and the fight against impunity in Côte d’Ivoire, as in the rest of Africa and worldwide, France reiterated its calls for an immediate halt to all violence against civilians, and underscored that the perpetrators of these crimes must be held accountable before a court of law. France welcomes President Ouattara’s pledge in this regard.”
Inhofe responds:
The only reported slaughter of civilians has been perpetrated by Ouattara forces currently allied with the UN and French. This occurred in the western town of Duekoue where up to 1000 people were massacred by the Dozos, traditional hunters who fought alongside Ouattara forces. This has been confirmed by the United Nations and Human Rights Watch.
French say:
“France is looking forward to the end of the current violence, and hopes that the constitutional and democratic order will eventually prevail. It is for president Ouattara and the people of Côte d’Ivoire to find the political solutions that will favor a democratic, peaceful, prosperous and reconciled nation.”
Inhofe responds:
Not true. President Gbagbo has called for an immediate cease-fire several times and has been ignored by Ouattara, the UN and French forces. The killings can come to an immediate end if these forces agree to a cease-fire.
Conclusion:
This past Wednesday, April 6, marked the 17th anniversary of the 1994 Rwandan genocide. We now know that UN General Secretary Koffi Annan and others knew of the extent of this violence early on, but did nothing about it.We all want to prevent another genocide from occurring.That is why the United States must call for an immediate ceasefire to prevent Ouattara and his rebel army from committing more mass slaughters of the Ivoirians. Lastly, I renew my request to Senate Foreign Relations Committee Chairman Kerry requesting that he convene a hearing as soon as possible into the atrocities committed by forces loyal to rebel leader Ouattara, as well as into what I believe were flawed elections that gave legitimacy to his claim of the presidency.
